The following supplementary2 provisions on issues concerning investment in cinemas by Hong Kong and Macao service providers in the Foreign Investment in Cinemas Tentative Provisions （State Administration of Radio， Film and Television， Ministry3 of Commerce and Ministry of Culture Order No. 21） and the annex4 are hereby formulated5 in accordance with the Supplementary Agreement to the and the Supplementary Protocol6 to the approved by the State Council， in order to promote the development of economic and trade relationship between the mainland and Hong Kong and Macao and to encourage Hong Kong and Macao service providers to establish enterprises that engage in film screening business in the mainland：
1. Beginning from 1 January 2005， Hong Kong and Macao service providers are permitted to build， renovate7 and operate cinemas in the mainland in the form of equity8 or cooperative joint9 ventures or wholly-owned enterprises.
2. Hong Kong and Macao service providers specified10 in these Provisions shall satisfy the definition of service provider and the requirements of the relevant provisions in the Mainland/Hong Kong Closer Economic Partnership11 Arrangement and the Mainland/Macao Closer Economic Partnership Arrangement respectively.
3. Other provisions on investment in cinemas in the mainland by Hong Kong and Macao service providers shall still be implemented12 according to the Foreign Investment in Cinemas Tentative Provisions.
4. These Provisions shall be implemented as of 8 May 2005.
